Terms of Service

1. Definitions

1.1: “Our”, “We”, and “Us” refer to the business of Nicki Reg.

1.2: “You” and “Your” refer to the person, parent, legal guardian, organisation or company requesting lessons from Nicki Reg.

1.3: “Regular Lessons” refer to lessons taking place on a set day and time every week or every other week during Worcestershire Term Time (e.g., weekly art lessons from 5pm–6pm every Monday in term time), or a regular set day and time outlined monthly for weekend lessons.

1.4: “Workshops” refer to a block of art lessons scheduled on specific dates (e.g., Beginners to Acrylic on 1st, 2nd, 3rd and 4th May, 9am–11am).

1.5: “Ad Hoc Lessons” refer to individually booked lessons.

1.6: Regular Lessons, Workshops and Ad Hoc Lessons may be delivered face-to-face or online.

2. Order and Acceptance

2.1: Bookings can be made via telephone, in person, by message, by email or through the online booking forms at www.nickiregart.com.

2.2: A Child Form or Adult Lesson Information & Agreement Form must be completed by You.

2.3: If Your child has a medical condition and/or requires life-saving medication, You must complete a care plan, which will be used in the event of an emergency. We do not administer over-the-counter medication or any non-life-saving medication to Your child.

3. Charges

3.1: Our charges are listed in the Sales Pages. These may increase or decrease, with one month’s notice provided. You will be emailed with any changes.

3.2: Regular lessons with a fixed weekly or bi-weekly time slot are paid for in full in half-term blocks. To secure Regular Lessons (face-to-face or online), payment must be made in full by the first lesson of each period (e.g., after-school lessons: paid in half-term blocks). Your lesson time, day and frequency are reserved exclusively for You/your child for the duration of the booking period. If You/your child is unable to attend a scheduled regular lesson, the lesson fee will still be payable in full, unless the space can be filled by an ad hoc booking.

3.3: To secure Workshops, full payment is required at the time of booking via the website or via the invoice.

3.4: Ad Hoc lessons must be paid at the time of booking or no later than 72 hours before the lesson. If an Ad Hoc lesson is cancelled within 72 hours, it is at Our discretion whether the lesson can be moved to another time or day.

3.5: If You wish to change or cancel the date/time of any Regular Lesson or Ad Hoc Lesson (face to face or online), once payment has been made, You must inform Us via phone call, message or email. Changes are granted at Our discretion and subject to availability. Changes may only be made twice to the original lesson booking; any further changes will be treated as a cancellation and the lesson will be forfeited with no refund or credit. For Regular Lessons booked in half-term blocks, any permitted lesson change must take place within the same half term.

3.6: Vouchers must be paid for in full at the time of purchase and used within 6 months.

3.7: Cancellation Charges If You cancel a Regular Lesson, Ad Hoc Lesson or Workshop (face-to-face or online), the following charges apply, at Our discretion:

Regular Lessons:

  • Notice greater than half a term: 0%

  • Notice less than half a term: 100%

Workshops:

  • Notice more than 7 days before the first session: 0%

  • Notice less than 7 days before the first session: 100%

Ad Hoc Lessons:

  • Notice more than 72 hours of the lesson: 0%

  • Notice less than 72 hours of the lesson: 100%

3.8: If You / Your child arrive late for a lesson or workshop (whether online or in person), it is at Our discretion whether the lesson (Regular, Workshop or Ad Hoc) finishes at the scheduled time or can be extended to fulfil its full duration. If you arrive late or discover you are late and notify Us, the missed portion of the lesson cannot be moved or rescheduled to another date. If We have not been notified that You are running late, We will wait for a maximum of 20 minutes after the scheduled start time. After this period, the lesson may be deemed a non-attendance and may be cancelled at Our discretion, with the full lesson fee remaining payable. For online lessons, if You experience technical difficulties that may affect Your ability to attend on time, You should notify Us as soon as reasonably possible.

3:9: If You / Your child fails to attend a lesson or workshop without notice, the full fee will still be charged due to the reserved time slot and limited availability.

3.10: We reserve the right to withdraw a student's place and refuse future bookings where there is a pattern of repeated non-attendance, frequent late cancellations, or failure to communicate regarding missed sessions. Reasonable exceptions may be made in cases of illness, medical treatment, family emergencies, or other exceptional circumstances at Our discretion.

3.11: If You have outstanding payments, We reserve the right to decline future bookings until the balance is settled.

3.12: We cannot hold or reserve places for clients without charge. Spaces cannot be reserved for extended periods (e.g., 3 months) without confirmed bookings and payment.

3.13: Payments may be made by BACS, card, cheque or cash, or via the website for online bookings.

3.14: If We need to cancel a Regular Lesson, Ad Hoc Lesson or Workshop (face to face or online) due to illness or unforeseen circumstances, no payment will be required from You. Any advance payment will be transferred to the rescheduled date or refunded. We will contact You to rearrange or cancel the session.

4. Your Responsibilities

4.1: It is Your responsibility to inform Us if Your child has any medical conditions or special requirements.

4.2: Art materials are used in accordance with manufacturer guidelines; however, participants are responsible for informing Us of any allergies, sensitivities or medical conditions that may affect their participation.

4.3: Aprons may be provided where appropriate; however please ensure that You / Your child is suitably dressed for the lesson or workshop, as clothing may become marked or damaged due to the art materials used. You/Your child are advised to wear suitable clothing. We cannot be held responsible for damage to clothing or personal belongings.

4.4: You must provide Us with up-to-date contact and emergency details for your child, so that We can reach You or a next of kin in an emergency. If Your details change, You must update Us before the next lesson or workshop.

4.5: You must notify Us of any changes to permissions, contact details or health conditions for Your child. Where applicable, a new care plan must be completed by You if Your child has changes in health.

4.6: It is Your responsibility to inform Us if You / Your child will not be attending an art lesson.

4.7: If You leave Your child with Us, You must remain nearby so that in the event of an emergency You can return to the lesson location promptly.

4.8: For online lessons involving a child, You must:

  • remain within earshot of the lesson;

  • keep the door to the room open;

  • risk-assess the art materials and tools to ensure they are safe for Your child to use;

  • use Zoom as the platform for the online lesson.

4.9: You / Your child must show respectful behaviour towards Us and other clients.

4.10: Due to lone working, if Your child is attending a group lesson and goes missing, We will contact You to assist, as We cannot leave the other children present. Please ensure You remain nearby if You leave Your child with Us.

4.11: We are committed to providing high-quality tuition, guidance, encouragement and constructive feedback. However, progress, skill development, confidence, examination results and qualification outcomes will vary between individuals and cannot be guaranteed. Whilst lessons are designed to support students in achieving their personal and academic goals, We do not guarantee specific grades, including high GCSE, A Level or other qualification results. Achievement is influenced by a range of factors, including attendance, engagement during lessons, independent study and practice, completion of recommended work, and the student's own commitment to the learning process. The greatest benefit from lessons is achieved when students attend regularly, arrive prepared, participate actively and undertake any recommended work between sessions. Learning is a collaborative process, and successful outcomes require commitment from both the tutor and the student.

4.12: You are responsible for ensuring they have suitable internet access and equipment to attend online sessions. Refunds will not be provided for technical issues occurring on the participant's side.

5. Our Responsibilities

5.1: We will provide art lessons that teach the skills, knowledge and understanding of art, whilst personalising the teaching to the needs of each client.

5.2: We will offer young people the opportunity to complete an Arts Award where We feel they are able to achieve it, and where You agree for Your child to participate.

5.3: All delegates will be treated equally and fairly regardless of age, race, gender, religion, sexual orientation, needs or disabilities.

5.4: Where necessary, We will adapt and scaffold teaching to meet an individual’s needs, both below and above their current level.

5.5: If We have a safeguarding concern about a child or vulnerable adult, We will record the incident and contact the local authority safeguarding board and/or the NSPCC directly, as well as the child’s school DSL where appropriate.

5.6: If You / Your child suffers an injury or illness, We will administer Emergency First Aid at Work or Emergency Paediatric First Aid as appropriate. An accident form will be completed by Us and shared with You.

5.7: In the rare event of a serious or life-threatening situation, or if a child goes missing from a group, the lesson or workshop will stop immediately so the situation can be managed. If children are present, We will contact You to collect Your child. If Your child is missing, We will contact You to assist, as We may be unable to leave the other children due to lone working.

5.8: Misbehaviour will be addressed verbally by Us and discussed with You at the end of the lesson. If behaviour is highly disruptive, continuous, or places Us or other children at risk, We reserve the right to exclude the child from future lessons and workshops. Child-on-child (peer-on-peer) abuse - including bullying, physical harm (e.g., hitting, kicking) and sexual abuse - is a safeguarding concern and will not be tolerated (see Safeguarding Policy for further details).

5.9: If the building must be evacuated due to a life-threatening event (e.g., fire), We will assemble away from the house but from the front. If children are present, We will remain together under Our care and contact You to collect Your child.

5.10: If lessons are held online via Zoom with children, the lessons will not be recorded.

6. Information Provide by and to Nicki Reg

6.1: Your / Your child’s personal information will be collected solely for the purpose of administering lessons and workshops, and for use in emergencies.

6.2: Photographs of artwork and activities may be taken for promotional purposes. Permission will always be sought from You before identifiable images are used.

6.3: All planning, training materials, presentations, resources and eBooks created by Nicki Reg are protected by copyright. All prints, cards and paintings produced by Nicki Reg are also copyrighted by Nicki Reg. These materials may not be used, copied, shared or reproduced without written permission from Nicki Reg.

7. Privacy

7.1: For information on how We collect and use the information You provide, the circumstances in which We may disclose it to others, how We keep it secure, and Your legal rights regarding any personal information We hold, please refer to Our Privacy Policy.

7.2: All child details, adult details, booking forms and care plans will be securely destroyed in accordance with GDPR law 6 months after Your / Your child’s last lesson, unless otherwise requested or specified by the adult, parent or legal guardian.

8. General

Terms & Conditions are subject to change. Existing clients will be notified of any updates in advance.
